Apple, Samsung and Google Could Face US Device Sales Ban Over Patent Dispute

Apple, Samsung and Google could face restrictions on selling or importing certain electronic devices in the United States following a new patent investigation by the U.S. International Trade Commission (USITC).

The investigation, announced on September 16, 2026, concerns certain electronic devices with audio technologies. It follows a complaint filed by California-based BoomCloud 360, which alleges that products from Apple, Samsung and Google infringe patented technologies.

Which companies are involved?

The USITC has named four respondents:

  • Apple
  • Samsung Electronics
  • Samsung Electronics America
  • Google

The complaint asks the USITC to issue a limited exclusion order and cease-and-desist orders. If eventually granted, such remedies could restrict the importation or sale of affected products in the US.

However, consumers should not interpret the announcement as an immediate ban on iPhones, Galaxy phones or Pixel devices.

There is no device ban yet

The USITC has only opened an investigation. It has not determined that Apple, Samsung or Google violated Section 337 of the Tariff Act.

The case will proceed through an administrative process. An administrative law judge will conduct an evidentiary hearing and issue an initial determination on whether a violation occurred. The USITC can then review that determination.

This means the companies still have an opportunity to defend themselves during the investigation.

What could happen next?

The USITC says it will establish a target completion date within 45 days of opening the investigation. If the Commission ultimately finds a Section 337 violation, it could issue remedial orders affecting the importation and sale of covered products.

Any such order would become final after 60 days unless the U.S. Trade Representative disapproves it for policy reasons during that period.

For now, there is no indication that consumers need to stop buying or using Apple, Samsung or Google devices in the United States.

Why this matters

Apple, Samsung and Google are among the biggest names in the US smartphone and consumer-electronics market. A future exclusion order could therefore have significant implications if widely used products are ultimately found to infringe the patents.

The exact products covered by the investigation, however, are determined by the USITC’s notice of investigation and the patent claims at issue. The investigation itself does not establish that every iPhone, Galaxy or Pixel product is affected.

For consumers, the important distinction is simple: a potential ban is being requested, but no ban has been ordered at this stage.

The case will now move through the USITC’s legal and evidentiary process, with a final determination expected later.
